Litigate Claims in New York and New Jersey

Long term care insurance is relatively new – policies vary widely in coverage, and many legal issues have yet to be resolved. Every day, ailing, aged or incapacitated individuals and their families are devastated to be told by their insurer that needed long term care services are not covered under the long term care policy they purchased and for which they have paid hefty premiums for many years.

One reason is that the insurance company is relying on the "wimp" factor, likely to be a major characteristic as people grow older and become more infirm.

Mike Quiat is at the forefront of this burgeoning field of law. As a New York and New Jersey long term care claim attorney, he offers more than 25 years of experience in litigation and insurance law. If you believe you or a family member was unfairly denied benefits,

Long Term Care Insurance

Long term care (LTC) plans were created to assure the highest quality of care in old age or incapacity. Policyholders should make sure that the terms of their long term care policies permit them to choose whether to utilize an inpatient facility or an at-home care plan for the desired level of care, so as to avoid state-run nursing homes.  Long term care insurance also eliminates the need to dissipate personal assets to qualify for Medicaid, because a good long term care policy can largely negate the shame and indignity of having to “qualify” for Medicaid. Most policies cover 24-hour care and other needs:

  • Nursing homes
  • Assisted living facilities
  • Home health aides
  • Durable medical equipment
  • Exclusions and Litigation

Often the fine print or the interpretation of contract terms by the insurance carrier results in denial of benefits. For instance, some policies will reimburse a family member who provides home care, but many do not. This may force families to entrust care of their loved one to a stranger. The insurer may refuse to pay for a particular facility, or deny payment for wheelchairs, lifts, home modification, assisted transportation, or other medical necessities.

Many times the insurer will hang its hat on a medical report provided by the policyholder's doctor.  This is because sometimes busy physicians do not take the time needed to fully and completely explain a patient's circumstances relative to the need for long term care.

Mike Quiat will examine the specifics of your policy and advise you on a course of action. Some insurers are open to negotiation. Other insurance companies may take a hard stand, necessitating litigation. Mike Quiat is a veteran trial lawyer who has prevailed against major insurance companies on behalf of clients.
